We know that a family breakdown is a stressful time, and we will try to assist you in reaching a settlement with the least amount of angst and expense. We can do that because our experienced approach is dedicated to sensible negotiation, and we do all we can to avoid aggravating an already stressful situation. We can help you negotiate a property settlement which legally finalises all aspects of property, including superannuation, so that the settlement is final and binding.  Once agreement between you and your former spouse or partner has been reached, we can prepare the necessary documents to give effect to the terms of settlement.  This may be either by way of a Binding Financial Agreement, or by way of Consent Orders made by the Family Court, and we will explain the differences in each process at your appointment.

Once you have reached agreement, or secured a Family Court Order, we can also then assist in the conveyancing aspect of a transfer of property required as the result of the settlement reached.

We can also assist in the negotiation of children’s matters, and the preparation of documents to give effect to those agreements, whether by way of Parenting Agreements, Child Support Agreements, or Consent Orders made by the Family Court. These agreements can include time spent by children with their grandparents.

We can also assist you in the preparation of Divorce proceedings, assuming you have been separated from your spouse for over 12 months.

Of course, if you and your former spouse or partner cannot reach agreement then we are there to assist you in the Court process from the time proceedings are issued, to the trial, and will explain the process thoroughly to you along the way. Fortunately, the majority of matters resolve without the need for a trial.
